Nous vous invitons à prendre connaissance de nos Conditions Générales de Vente « CGV » avant d’utiliser notre site Internet : www.maisontila.com, (le « Site ») et/ou d’effectuer un achat. Sachez que tout achat en ligne implique l’acceptation pleine et entière des présentes CGV. Les CGV s’appliquent entre vous, en tant que consommateur et non professionnel, et nous, société Leana Trading Sarl au capital de 60 000 €, dont le siège social est situé au 7, Rue Gounod, 75017 Paris, inscrite au Registre du Commerce et des Sociétés de Paris sous le numéro 410 965 404. Notez que ces CGV sont susceptibles d’évoluer car nous nous réservons la possibilité de les modifier à tout moment selon les évolutions du Site et/ou de la réglementation. Nous souhaitons vous préciser que ce sont les CGV en vigueur au moment de la passation de votre commande qui vous seront applicables. 1. YOUR CUSTOMER ACCOUNT

In order to order on our Site, you can create a customer account via the "Create an account" section or place an order without creating a customer account, as a guest. Creating an account allows you to:

  • to fill in your personal information in order to facilitate your future purchases;
  • consult, modify and update your personal information;
  • to identify yourself before placing an order;
  • track your current orders and view invoices for past orders.

If you order as a guest, you will be able to track your order via the "Track my order" page on our Site with your order number.

By ordering on our Site, you confirm that you are a private individual, and that you are purchasing our products for personal use in quantities corresponding to the usual needs of a consumer's household. Under no circumstances may our Site be used by professional sales "customers". We reserve the right to refuse any order that is clearly validated by a professional customer.

You are responsible for maintaining the confidentiality of your customer account and password, and for restricting access to your computer or other equipment. As such, you acknowledge that you are responsible for all activities that occur under your customer account. If you suspect that your customer account is being used by a third party, we recommend that you change your password and contact us to close the usurped customer account, if necessary. 2. HOW TO ORDER ON OUR SITE

You can order your favorite items directly from our website.

Product offers and prices are valid as long as they are visible on the Site, while stocks last. In the case of special offers, the duration of the offer will be indicated on the Site and in our newsletters. Our products may be temporarily unavailable, and you will be informed of this on the product sheet. We invite you to enter your email address to be alerted as soon as your favorite item is back in stock, thanks to our "Unavailability Alert".

Ordering is easy!

  • Select your items and add them to the shopping cart. You can check the number of items in your basket at any time, and obtain detailed information on each item by clicking on "Basket". Once you have added an item to your shopping basket, you can continue shopping by clicking on "Continue shopping";
  • Once you have completed your basket, click on "Finalize my order";
  • Log in to your customer account, create an account if you don't already have one, or continue as a guest;
  • Choose the delivery method you prefer and fill in your delivery address;
  • Choose your payment method (see "How to pay for your order" below for more information on payment methods), read and accept the full terms and conditions and proceed to secure payment of your order. Payment of your order implies full acceptance of these terms and conditions;
  • Your order has been confirmed! You will receive an email confirming your order.

By placing an order, you declare that you are at least 18 years old and that you have legal capacity (or if you are a minor, that you have parental authorization to place your order).

  • Once your order has been prepared by us, you will receive an email informing you that your items have been dispatched. You will then be able to track the status of your order using the tracking information contained in the email. If you do not receive an email (either confirming or dispatching your order), please contact us for further information.
  • We may be obliged to cancel your order for a legitimate reason, for example: when you have been able to place an order but your product is no longer available: we will inform you of this as soon as possible and reimburse you the amount of your article as soon as possible when a technical error occurs during your payment;
  • When an obvious error has crept into the product sheet (for example, when there is an error on the essential characteristics of the product, or when an obviously erroneous price is displayed);
  • When we observe fraudulent or abusive use of your account or related orders;
  • Where we reasonably believe that you have breached our T&Cs.

3. OUR PRODUCT PRICES

The prices of our products are indicated on the Site in euros, all taxes included (VAT), excluding shipping costs (which will be specified when you choose your delivery method). They include Value Added Tax (VAT) and any discounts applicable to our commercial operations in force on the day of your order.

HOW TO PAY FOR YOUR ORDER

Payment for your order is made directly online by credit card (CB, Visa, MasterCard, American Express) or Paypal. You also have the option of paying in 4 instalments, free of charge, with Paypal or Klarna for orders of between 100 and 1,000 euros (you will be charged monthly).

Once your payment has been confirmed by our payment service provider, your bank account or Paypal account will be debited for the total amount of your order (except for Paypal payment in several instalments for which your bank account will be debited 4 times).

We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data with our payment service provider.

At no time do we have access to your personal data concerning your means of payment, in particular your credit card details, and we do not store them on our servers.

However, you may wish to save your bank details in your customer account so that they can be used for future orders. To do so, simply tick the "Save your payment details" box when you make your payment. In this case only, our payment service provider will store your data in encrypted form. You can delete the credit card you have registered either directly in your customer account, under "My payment options", or by clicking on "Delete".

When will your order be delivered?

Your order will be processed and dispatched within 24 / 48 hours (working days).

Please note that it may be extended during busy periods (e.g. sales periods).

You will be able to track the progress of your order as soon as you receive the email confirming shipment of your order with tracking information.

If you are absent when your order is delivered, you will be given a notice to collect your order.

Maison Tila is responsible until the product is delivered to the customer.

It should be noted that the customer has three (3) days to notify the carrier of any damage or partial loss on delivery.

6. WHAT ARE OUR RETURN, REFUND AND EXCHANGE POLICY?

In order to facilitate the return of your products, we grant you a maximum total period of 30 days from receipt of your order to return your products under the conditions described in article 7.

The products you wish to return must be new, undamaged and in their original packaging.

Your return by post is carried out in two stages:

You have 15 days from the date of receipt of your order to cancel your order. During this period, you must exercise your right of withdrawal. If you have a customer account, go to "My account", in the "My orders" section. Select the order concerned and click on the "Return" button. You will then receive an email confirming that your request has been processed. - You then have 15 days from the date of the above e-mail to return the goods.

To do this :

  • Tick the product(s) you wish to return on the delivery note in your parcel;
  • Insert this delivery note in your return package along with the product(s) to be returned;

When will you be reimbursed?

Once your return has been verified by our services, you will receive an email confirming your refund. We undertake to refund you the amount corresponding to the product(s) returned, as soon as possible and no later than 14 days following the date of receipt of your return in our warehouses. Your refund will be made directly to the credit card or paypal account used to pay for your order. You will receive an email confirming your refund once it has been validated by our systems. You can follow the progress of your return directly in your customer area, under the heading "My orders", or under the heading "Order tracking" if you placed your order as a guest.

Any product returned that is not new, damaged, broken, or without its original packaging will be returned to you and will not be reimbursed.

7. WHAT GUARANTEES DO YOU OFFER FOR YOUR PRODUCTS?

Our products are covered by legal guarantees, i.e. the legal guarantee of conformity and the guarantee against hidden defects. In our capacity as seller, we are obliged to :

  • defects in conformity of the products you purchase, under the conditions of article L.217-4 et seq. of the French Consumer Code. The legal warranty of conformity applies when your product has a defect of conformity, for example when your product does not function in accordance with its usual use, or when it does not correspond to the description given;
  • and its hidden defects under the conditions of article 1641 et seq. of the French Civil Code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. a defect that is not apparent at the time of sale, which renders the product unfit for its intended use, or which significantly reduces that use. Please note that the legal warranty of conformity and the warranty for latent defects will not be applicable in the event of misuse of your products or failure to comply with maintenance conditions.

8. YOUR PERSONAL DATA

We treat your Personal Data with the utmost care and confidentiality.

9. LIABILITY AND FORCE MAJEURE

We undertake to describe the products we sell on the Site as accurately as possible and to keep the information published on the Site as up-to-date as possible.

We shall not be held liable in the event of a breach of any of our contractual obligations resulting from a case of force majeure as defined by French law. In particular, we shall not be held liable for any non-performance or delay in the execution of your orders, caused by events beyond our control, such as :

  • Strikes, closures or other industrial actions ;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disasters;
  • Inability to use rail, sea, air, road or other means of private or public transport;
  • Inability to use public and private telecommunications networks;
  • Acts, decrees, legislation, regulations or restrictions issued by any government (e.g. administrative closure of stores);
  • Failure or accident of maritime, postal or other transport.

The performance of the GTC will be suspended for as long as the force majeure lasts, and performance and delivery times will be extended accordingly. Please note, however, that we will do our utmost to put an end to the case of force majeure or to find a solution enabling us to perform our contractual obligations despite the case of force majeure.

10. ECO-ORGANIZATIONS

We are registered with the CITEO eco-organization, whose aim is to facilitate the monitoring and control of compliance with packaging EPR (Extended Producer Responsibility) obligations, and are up to date with our eco-contributions. Our company was awarded a "COMMITED" badge following an environmental, social and societal audit (Corporate Social Responsibility) carried out by ECOVADIS; https://ecovadis.com/fr/

11. WHAT IF WE DISAGREE?

We don't want to, but we may disagree!

Please note that our terms and conditions are governed by French law, and that your orders are subject to the terms and conditions in force on the date of your order.

If we are unable to reach an amicable solution, the French courts will have jurisdiction and French law will apply.
